Terms of Service

1. About us

BotBrain Digital is a trading name of BotBrain Ltd, a company registered in England and Wales under company number 12437055. Our registered office is 805 Elvin Gardens, Wembley, England, HA9 0QG. Contact us at contact@botbraindigital.co.uk.

2. Who these terms apply to

Our services are designed primarily for businesses. By ordering on behalf of an organisation, you confirm that you have authority to bind it. If you purchase as an individual consumer, your mandatory statutory rights are not restricted by these terms.

3. Services and scope

The package description shown at checkout is the starting scope. Before substantial work begins, we may confirm requirements, content, delivery assumptions and exclusions by email or onboarding questionnaire. Work outside the agreed scope—including extra pages, products, integrations, content entry or revision rounds—requires a separate quotation.

4. Your responsibilities

You must provide accurate instructions, timely feedback, suitable text and images, and any required access credentials. You confirm that materials you supply may lawfully be used and do not infringe another person’s rights. Delays in providing information or approvals may delay delivery.

5. Prices and payment

Prices are in pounds sterling. BotBrain Ltd is not currently registered for UK VAT, so UK VAT is not added. Payment is processed securely by Stripe. Unless agreed otherwise in writing, project packages are paid in advance and work begins after payment and receipt of the required onboarding information.

6. Delivery and revisions

Any delivery date is an estimate unless expressly agreed as a fixed deadline. A revision means a reasonable change to work already produced within the agreed scope; it does not include a new concept, new page or changed project brief. A project may be treated as approved if we receive no response for 14 days after requesting feedback.

7. Cancellation and refunds

Cancellation is governed by our Cancellation and Refund Policy. Business customers do not receive a statutory cooling-off period. Consumers may have a 14-day statutory right to cancel a distance contract, subject to the rules covering services started during that period.

8. Website Care Plan

The Care Plan renews monthly until cancelled. It includes the work listed at checkout and up to 30 minutes of minor content changes per month. Unused time does not roll over. Major design work, new pages, emergency recovery caused by third parties and third-party subscription charges are excluded. Cancellation takes effect before the next renewal; payments already made are not normally prorated.

9. Intellectual property

You retain ownership of materials you provide. Once all amounts are paid, you receive the rights needed to use the final website created specifically for you. BotBrain Ltd retains ownership of its pre-existing methods, reusable code, templates, tools and know-how. Third-party software, fonts, images and plugins remain subject to their own licences.

10. Third-party services

Domains, hosting, payment processors, plugins and other third-party services are supplied under their providers’ terms. We are not responsible for an outage, policy change or failure outside our reasonable control, but we will provide reasonable assistance where covered by your package.

11. Liability

Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud or for death or personal injury caused by negligence. Subject to that, our total liability arising from a project is limited to the amount you paid us for that project in the 12 months before the claim. We are not liable for indirect loss, lost profits, lost opportunity or loss caused by inaccurate client materials, third-party services or unauthorised changes.

12. Confidentiality and data

Each party will protect confidential information received from the other. Our handling of personal information is explained in our Privacy Notice.

13. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, without limiting any mandatory rights a consumer may have in their home country.
